Georgia Child Custody & Visitation

Experienced Georgia Family Law & Divorce Attorneys

In the event of a divorce, one of the primary areas of concern is what will happen to your children. Georgia child custody & visitation is not only a major issue for you and your spouse, but will also be of vital interest to the court overseeing your Georgia divorce as well as your GA divorce and child custody attorney.

In some cases, joint child custody will be in the best interest of the children, allowing both parents to continue to actively participate in their children's lives. In other cases, sole custody in Georgia may be more appropriate. In these instances, the non-custodial parent is usually awarded child visitation rights that allow him or her to continue to maintain contact with their children.

Child Support

In most Georgia cases, both parents will be held financially responsible for their children until they turn eighteen. If one parent has sole custody, the other parent will usually be expected to pay child support to the custodial parent. These payments are to  help cover the costs of raising the child, including living expenses, costs incurred through school, health care expenses, and more.

Age, Child Custody, and Child Visitation

Sometimes under Georgia child custody law, a child can have a say in which parent they live with. Children over the age of fourteen are generally permitted to tell the judge their preference during the child custody proceedings. Younger children, ages 11-13, can also make their preferences known to the court, however a GA judge is not required to honor the request if they do not believe it is in the best interest of the child.
