Georgia Family Violence Protective Orders

Family violence in Georgia occurs when a family or household member harms or attempts to harm another family or household member.  Family violence also includes threats of violence or a strong belief that a family member will cause harm in the near future.  Family violence in Georgia is a serious crime and laws are in place to protect the abused.

A GA Family Violence Protection Order is a legal document written by a court prohibiting a member of a family or household from remaining in the household or from contacting or coming near the abused.  If the abuser violates the order then serious legal consequences will result with violation being punishable by a large fine or confinement in jail for an extended period of time.  Both males and females can seek the civil legal protection of a GA Family Violence Protection Order.

Specifically, the order may state that an abuser must:

* Leave the abused alone
* Leave the place of residence (If the abused is not in possession of the home assistance to obtain personal property and temporary residence is granted)
* Give the abused temporary custody of children and set temporary visitation
* Award the abused with temporary child/GA spousal support
* Attend counseling

To obtain a Family Violence Protective Order an application must be filed with the court.  A citation will then be sent to the alleged perpetrator and a court hearing will be held.  If the order is granted it can be effective for up to a year although if the threat of abuse still persists a court can extend the order.  A GA temporary restraining order may also be requested for the time required to serve the citation to the abuser and hold a hearing.

  1. The idea of Family violence protective orders is so good.It seems like we can’t read a newspaper without seeing some victim of domestic violence being killed this days. And truly like you said it causes complexities.I would also advise any abused person to contact a family attorney immediately if they feel they really need help.

    I never knew Family violence protective order had so much benefits and I have never even considered it,but does it really cover child support or they are quite different entities? I am really considering this.

    Despite what many people believe, domestic violence and abuse is not due to the abuser’s loss of control over his behavior. In fact, abusive behavior and violence is a deliberate choice made by the abuser in order to control you.Family or no family,get a protective order.

    Once the court grants a Family Protective Order, it will be effective throughout the state of Georgia, and the abuser will have to follow the terms of the order. If your abuser violates the terms or the order, you can contact the law enforcement agency in your area and he can be arrested.

    Those in closest contact with a victim of domestic abuse need to know that research shows that a woman is most at risk of harm when she is planning to leave an abusive relationship. So it is better for any woman in than kind of situation to get a protective order.

    Most agree. Everyone have the right to control their own bodies. Even though sometimes family violence can be hurtful, some try to keep silence. I also recommend that anyone in this loop should see a lawyer immediately.

    I think the real reason why people are a little bit afraid of filing a family protective order, is just in case the person to which the order is against defiles the court and does more damage. I really think the court should try and make some legislation that makes these orders very sound and a must keep.

    I still keep wondering why people would want to hurt there own family. As for me if it comes to that ,protective order all the way…Why should I be concerned about them too.
