Georgia Family Law & Estate Planning

Experienced Georgia Family Law Attorneys

When you are dealing with any sort of family law issue in Georgia, it is important to keep in mind all of your estate planning needs. For instance, after a divorce in Georgia, it is important to note that your divorce decree will automatically void your Last Will & Testament. Fortunately, when you are working with an experienced family law attorney, you may find that planning for your estate is not nearly as complicated (or distasteful) as you may fear.

Whether or not you have significant assets in Georgia or in other states, creating a Last Will & Testament will be the best assurance that upon your death all of your assets will be distributed according to your own specifications.  If you have experienced the nightmare of family members fighting over personal possessions after the loss of a loved one, you know that you do not want to put your own family in such a position.

When creating a Last Will & Testament, a critical factor which our family law and estate planning attorneys will discuss with you is whom you will appoint as the executor of your will.  Since this person will be responsible for carrying out your wishes, it is important that he or she be someone who is mature and trustworthy.

In addition to a Last Will & Testament, our family law attorneys will talk with you about creating a Georgia Power of Attorney.  This document will allow a trusted individual to act on your behalf regarding financial matters if you are personally unable to do so.  Hand in hand with a Power of Attorney would be a Health Care Proxy, which allows an individual to make health decisions on your behalf.

An additional consideration for your estate planning needs will be creating a Living Will. This is sometimes also referred to as a Directive to Physicians.  Your directive in Georgia will specify, among other things, such factors as the degree of medical intervention you want if you are unable to voice your wishes.

Finally, our family law attorneys will discuss making decisions on the beneficiary of your life insurance policy, whether or not you will choose to donate your organs, and other matters.
